Ethics in the Workplace Essay In 1995 Douglas Durand went to work for Tap Pharmaceuticals as vice- president of sales. Several months after starting at Tap Pharmaceuticals, Durand was in disbelief to find out that the company was bribing urologists to purchase the new Lupron drug for prostate cancer. Durand found the culture at Tap Pharmaceuticals to be in misalignment. In order for Durand to protect his good name, he began to document all his findings over a 6 year period and submitting the information to federal prosecutors. The documentation that Durand submitted to the federal prosecutors was so overwhelming that it caused Tap Pharmaceuticals to plead guilty to conspiring with doctors and cheating the government. As result of the guilty plead, Tap Pharmaceuticals paid a staggering $875 million dollar fine, which Durand received 14% of the settlement for his efforts to remedy the situation. The symptoms found in the Tap Pharmaceuticals case are primarily driven by numbers and monetary rewards. The more the top sales reps could sale or distribute the bigger the monetary reward. Durand tried to institute a more structured environment to help remedy some of the illegal practices he encountered. Many of the sales reps at Tap Pharmaceuticals did not accurately track the samples of Lupron given out to doctors. Durand offered a year salary to sales reps to help the company keep accurate records of distribution of the drugs offered. It worked until upper management shut down the bonus program, furthermore; the reps settled back into their old ways. Symptoms of dishonesty, unethical behavior, inadequate record keeping, crooked doctors, and a complete disregard for laws and regulations set forth by the government are derived from the root cause of poor upper management found at Tap Pharmaceuticals. The root cause and unresolved issues that Durand encountered at Tap Pharmaceuticals are a direct result of the monetary driven culture created by then president Yasu Hasegawa and senior management. Durand found that when he tried to implement new policies or practices that Hasegawa and the sales reps were not interested, or he was undermined by senior management. Tap pharmaceuticals primary sales niche was to bribe and payoff the people who prescribed the drugs offered by purchasing televisions, vacations, and  office equipment. The unethical practices are a direct result of a lack of unethical leadership and ethical standards and practices not being in place. Tap Pharmaceuticals did not have a hose counsel to help keep practices ethical and meet government requirements because it was thought to be a sales-prevention department. Durand eventually found himself excluded from marketing and sales meetings and told that he just did not understand the culture. The lack of ethical leadership in the company is the root of the problem found at Tap Pharmaceuticals and left all the issues that Durand found unresolved. Analyze and evaluate alternatives. Decide on the most valid alternative, and make recommendations. When thinking of alternatives, people think of other options that may apply in order to have a different outcome than the current outcome. When Durand was offered the position as Vice President of Sales with Tap Pharmaceuticals, he had no idea what he was getting involved with. All he saw was a potential for a promotion in an industry where he had already served his time and made a name for himself. Durand has a couple alternatives in this ethical situation. He could have kept his mouth shut and adhered to Tap Pharmaceuticals policies and procedures and unethical practices. The outcome to this alternative could have proven to be very poor for Durand. If Durand continued to allow Tap Pharmaceuticals to conduct business in the sales department as they always had in the past, eventually, the federal government would have caught on to the unethical practices and levied fines against Tap Pharmaceuticals and Mr. Durand. He could have even been prosecuted for the practices he witnessed at Tap Pharmaceuticals. When employees are directed to blatantly break the law in order to keep sales up and to give out medicine samples without charging for them, there is a huge ethical problem. Tap Pharmaceuticals instructed the doctors to charge Medicare for the samples even though they never paid for them in the first place. It seemed as if Tap Pharmaceuticals planned to break every law of the trade in order to make the most money in the least amount of time. This alternative would not work for Mr. Durand. He had a steady head on his  shoulders and would not stand for the unethical practices he had witnessed. But what would he do about the problem? This question would later come into play when Mr. Durand was faced with a tough decision. A second alternative Mr. Durand had was to leave Tap Pharmaceuticals with a resignation. But a resignation would land him and his family out on the streets. He did not want to jeopardize his familys lifestyle and affect the way his children would grow up. After all, Mr. Durand did leave a well paying job with a huge medical pharmaceutical company. This alternative would be even worse than staying with Tap Pharmaceuticals and pretending nothing wrong was going on. He had to support his family and to Mr. Durand this was the most important issue to handle. If Mr. Durand resigned from Tap Pharmaceuticals, he would have to start all over again and work his way back up the corporate ladder as he did 20 years before with Merck Co. Mr. Durand had very few options or avenues to take in his ethical dilemma. He was virtually stuck between a rock and a hard place. He truly made the perfect decision when he decided to file suit against Tap Pharmaceuticals. This was the best possible option he could have used. First, Tap Pharmaceuticals was breaking the law and if they continued to practice unethical business, they could have hurt someone or continued to defraud the United States government and Medicare. Since Mr. Durand was familiar with the practices of the pharmaceutical industry, he had no other choice but to blow the whistle on Tap Pharmaceuticals. TAP Pharmaceuticals, a physician, and 7 employees of TAP Pharmaceuticals were charged and indicted for bribing physicians with kickbacks to use the drug Lupron. The federal grand jury also found them guilty of Medicare fraud, and violation of the Prescription Drug Marketing Act. Whenever he implemented a new structural change, the employees would try it for a short while and return to the way they had done things in the past. Accurate bookkeeping was a logical idea to put into action. This would tell exactly how much each rep gave out to doctors and pharmacies as samples for them to try out. The old way never showed how much they were paid for each sample given because there was no way to know how many had been given out. Whenever new ideas are put into effect, it still takes people to uphold these new rules and regulations. When Yasu Hasegawa failed to show any sort of business ethics, why would any of his employees? A good leader will lead by example. When people follow someone he/she want to emulate his/her actions, not just his/her words. By having a person with little moral fiber lead the company, it allowed some that might have been on the fence about the situation to fall to the same side. Durands cultural change effort failed because senior management and older sales reps refused to change the company for the better. They had been doing things their way for too long and the payoff incentive was too great. The shady business practices were much easier than trying to keep records of exactly how many samples were given out and who all had been bought. When  the president of the company would not even change his ways on how he dealt with his business, how could his employees be expected to change as well? In a business that deals with healthcare, the most important aspect should always be the patients. Since nobody truly cared about them and all the employees concerns were with lining their own pockets, the business ended up being sued for quite a large amount of money. The only way for Durands changes to succeed, would be if there were a total overhaul of management. The company would need to basically start over in order to weed out all the bad eggs. That would take a great deal of time, not to mention a great deal of money. Even though Durand became a whistle-blower on Tap Pharmaceuticals and the company was fined, there are sure to be employees who were guilty but not indicted. In TAP Pharmaceuticals there was an attitude of a misalignment of culture. The profit driven only environment provided no ethical leadership. Upper management including the CEO, who set the tone of weak unethical leadership, held no interest in change. TAP had no formal cultural system. The bottom line was the only factor and how profits were obtained was of little concern. When Durand attempted to make positive changes to the system through a Reward System, upper management put a stop to it even tough it was working and labeled him a trouble maker. TAP was not interested in positive ethical change. The gifts to urologists and doctors TAP pharmaceuticals participated in set an unethical culture. ConclusionIn the end Tap received one of the largest fines in the pharmaceutical industry and the job of rebuilding its image and reorganizing its business practices. Seven of its senior management team received heavy financial and judicial penalties for their part in the Lupron scandal. Douglas Durand in the end had to start over in a new less lucrative position, furthermore; he did receive a large settlement from the federal government under the Whistle-Blowers Act and currently retired and living in Florida. These were the final words of the last great empress of China, Tzu Hsi. In a sense this statement was ironic. For almost 50 years this one woman ruled China with a graceful but iron fist. The Last Great Empress of China, written by Charlotte Haldane, is the story of how Tzu Hsi (1861-1908, rose to power and managed to keep it. Known by several names through out the course of her life, Tzu Hsi was intelligent, beautiful, and had a voice that could charm anyone. Chosen as an Imperial Concubine in the third class, Yehonala (as she was known at the time) took great care to win the favor of the current Empress Dowager. Her next step was to win the favor of the young Emperor Hsien Feng, which she accomplished with the help of the Chief Eunuch, who she had also won over. In her quest for ultimate power the luckiest event that befell her was the birth of her son. Because the Empress Consort Sakota failed to produce an heir, Yenonala’s son was to become the heir apparent, raising her to the position of first rank concubine. Throughout the course of her life, Tzu Hsi played her cards well, continuously increasing her power. Tzu Hsi’s thirst for power caused her to be the center of several scandals over the course of her reign. It is said that she arranged the death of the Empress Consort Sakota (also known as the Tzu An) and two influential concubines whom she deemed a threat to her authority. Not being able to accomplish these deaths on her own, Tzu Hsi turned to those closest to her, the royal eunuchs. Though the eunuchs as a rule were not to speak unless spoken to first, the Chief Eunuch, whoever he was at the time, became her closest confidant.

My Seventieth Birthday Speech â€Å"The seventieth birthday! It is the time of life when you arrive at a new and awful dignity; when you throw aside the decent reserves which have oppressed you for a generation and have stand unafraid and unabashed upon your seven-terraced summit and look down and teach-unrebuked. You can tell the world how you got there. † Mark Twain Good afternoon family and friends, I am privileged to be here today to celebrate with you my seventieth birthday. Today is a day I will remember fondly if health allows me to, for seventy is a good long time to live- I should know!In addition, it is truly something to celebrate. In the presence of everyone, my husband Alexander, my sons Alexandre and Vito, my daughters Thea-Simone and Mikaela, my 13 grandchildren and my three great grandchildren. I can proudly say, you are the reason I live today. Who I am today is a product of my earlier socialization, my experiences and my ambitions. I may be described as an in trovert, as you all know; I am quiet by temperament and flourishes in my own company and space, until I met my husband.Alexander and I met when we were in high school, we were friends first, however; a few years later the friendship has grown into something more. We both got accepted into a four year college where my major was psychology and his was biology. I graduated with our bachelor’s degree and then moved on to graduate school at Harvard University to further advance my studies to doctorate’s degree. In the latter part of graduate school I found out that, we were going to have a baby. Above all things I worried about being a good mother to our baby. I looked forward to its birth amidst the support of friends and family.Understandably, I became alarmed when my doctor spoke about his concern about the hike in my blood pressure. He cautioned me about the dangers of high blood pressure levels especially during pregnancy. I immediately changed my diet as per recommend ation and did a critical self-reflection in my quest to de-stress and restore my blood pressure to normal. It was indeed a scary time for me when my blood pressure seemed beyond control and I had to be hospitalized for treatment in the latter trimester of my pregnancy. At this point, the doctor has decided t best that I await the birth of my baby within the hospital walls, luckily, it was almost time. Looking back now, I am amazed that I found the strength to take the next step. When my daughter was born, I was devastated to learn to that, she had but a fifty-fifty chance of surviving as a direct result of the dangerously high blood pressure levels during labor. She stayed with us for a couple hours before she passed on, leaving behind devastation in her wake. I was at a low place in all faucets of my life during this time. I was crippled by grief and felt as if I had come to the end of my journey.I could not help feeling that this was a personal blow to me by God. I wondered how he could have allowed something so drastic and final to happen to me. I wondered if I was being punished for some terrible wrong that I had done. I had to dig deep inside of me to hold onto my faith in God and find the strength to pick up the pieces of my life. I was encouraged to mourn my baby by not living in denial and resume University as soon as I was able, as staying at home for an extended period as was previously planned would hinder the healing process.I conceded and returned to school hoping to fill the vacuum that the baby’s death had left inside of my soul. Had it not been for the wonderful people who entered my life and embraced me as one of their own, my coping skills would have been non-existent. Together they created a very strong support system and constantly encouraged me to hold on to my dreams and aspirations, remaining focused and surmounting each obstacle as they arose. The future was unpredictable in its entirety but I tried to remain focused and continue to believe in that which I want to achieve for myself.I knew I could not do it all by myself and I am forever grateful to my wonderful husband who stood by me through happy times and sad ones and for all the assistance I have received then and now that has helped to shape who I am today. My hard work and determination has paid off, now it is time for me to have fun. I am now retired from being the CEO of the Middleton Psychiatric Hospital and has passed down the honors to my eldest son Dr. Vito Samuda. Blind cane Our s-cane will have several unique features that will outstand and give our product a chance to compete with the other existence cane out there in the market. 2. 3. 1 Unique features * Build in Global Positioning System (GPS) that will help in navigating the blind person to the place that he or she wishes to go to. * Earphone provided to aid the blind person in hearing commands given to them by the s-cane. * Build in ultrasonic sensor that will help in identifying obstacles ahead to prevent the blind person from hitting or misjudge the path that they are walking into. Retractable front end tip of the cane that will help the blind person in keeping their s-cane safe in their bag or even their pocket. * The s-cane also has a build in radio that can provide some entertainment to the blind person. Don Higginbotham expertly combines both primary and secondary sources providing the reader a composite historical narrative of the American Revolution as â€Å"seen through American ideas.† Higginbotham was Dowd Professor at the University of North Carolina at Chapel Hill until his death in June 2008. Higginbotham contributed several articles on comparative revolution and many other books and articles about the American Revolution. The book’s subtitle is Military Attitudes, Policies, and Practice 1763 – 1789. However, Higginbotham devotes substantial attention to other themes providing the reader with a synthesized version of the political and military aspects of the war. He also addresses the cultural and social aspects of the war. In doing so, he illustrates how the war affected the development of an American identity and how whig philosophy translated into everyday reality for the common man. Finally, he uses the book to compare the Vietnam conflict to the American Revolution. The author never directly discusses the development of an American identity, but one can see that thread as he discusses the militia system and its reinforcement of the provincialism and localism during the period (7). Higginbotham continues this theme, contending that a group of â€Å"American political leaders† emerged within the Continental Congress who were nationalists and desired to go beyond the simple provincial assemblies (81). Higginbotham maintains this concept, proposing that Manifest Destiny may have been an issue as early as 1776 in the colonial discussions concerning the invasion of Canada (108). The concept of an American identity came to fruition in 1776 when opinion concerning independence grew increasingly favorable (117). One could argue, however, that most Americans possessed little concept of an identity even after the Declaration was signed. Nevertheless, in 1781 the Pennsylvania line must had some concept of an American identity. After revolting due to lack of pay and other necessary items, one soldier remarked that, â€Å"Clinton might ‘bribe such a mean toadeater as Arnold,’ but ‘it is not in his power to bribe an American soldier’† (404). Without an innate knowledge of what an American soldier was, it seems unlikely that such a remark would have been made. Higginbotham clearly demonstrates how colonial Americans internalized whig beliefs and turned them into action not only resisting British authority, but also resisting its own Continental Army. At home he is depicted as a tyrannical leader and is constantly enforcing his position in the family by means of instilling fear and in turn he receives blind obedience, discipline and most importantly the ‘perfect family’. His methods of enforcing his position ranges from extreme physical abuse which is vividly portrayed when he beat Mama to the point of her having a miscarriage and when he beat Kambili and Jaja for â€Å"walking into sin† in Nsukka ,to emotional abuse when he intimidated Kambili in front of her peers for ‘choosing’ to come second in class. Actions such as these or ensuring that his children follow a strict schedule designed by him could easily change the reader’s perception of Papa into a negative one, but it is is justification and his his role in the community that sways the reader’s perception of him. His justification for his actions is portrayed through his fanatical belief. He feels that it is his moral obligation to punish those that have sinned which in turn redeems them their place in heaven. This is continually represented by his emotional state whilst punishing a family member, crying while pouring water over Kambili’s feet, his swollen eyes after finding out about the miscarriage and the remorse that he felt after Mama left for Nsukka. It would be a fairly accurate deduction that Papa does monstrous things, but he also does good throughout the novel which proves that he is not a monster nor is he a saint.

It also informs immigrants the atypical worldview of the American country they are adopting. Hence, these set of worldviews are categorized in five dimensions. In America, the first identified dimensions of worldview is that time focuses on the future instead of the past. Living for-the-moment and living according to the past are both perceived as inappropriate by American standards. Americans live in the future and find it crucial save money for their retirement or for their children’s education. On the other hand, some immigrants are more present oriented so they will spend money on only the most essential things they need at that moment. The concept that humans should be able to master nature is another aspect of the worldview. This worldview suggests that we should be able to defeat diseases at all costs, thus American families will take any surgical procedures necessary in order to cure their family member from a disease. However, some immigrants view this idea much more differently. They will consider the disease a reflection of some imbalance in living so changing their way of life would be more effective or that such disease is part of their destiny. We Americans would have trouble understanding such decisions. In the American perspective, the third identified dimension of worldview is that human nature is said to be good or mixed. The author declares that personal freedom is core value as it suggests that the society as a whole will function if you count on the individuals to live up to their best selves. The fewer constraints enforced on people the better. Some cultures, on the other had view human nature as pessimistic and selfish thus, it is considered bad. In this case, in order for people to stay on the right path  they need to be monitored closely to avoid negative impulses. Another identified dimension from Ingram’s article refers to the individual’s wishes, needs and aspirations being more important regardless of their groups or family and if needed, it is appropriate for an individual to move away to become independent. In America, since the social relations sense is individuality, college students are able to decide on their own majors, young women have the freedom to live in their own apartment, and young men who have jobs are not obligated to give money to the family. However, in several other cultures such behaviors are considered disrespectful. A personal example would be ever since I was young, everyone in my family wanted me to pursue a career in the medical field. Once I started community college, I took a few courses pertaining Pharmacy Technology and Medical Assistant but I realized these careers did not meet my interests. It was difficult telling my family what truly interested me and they were disappointed for a while, but in the end they were supportive. In some cultures we may seem heartless or selfish for not following what our group or families instilled us, but we are simply taking care of ourselves according to the American worldview. The fifth identified dimension of worldview is that what one does or accomplishes, is more important than the way they conduct themselves. A person’s job is highly important in determining one’s relative value in the society. Athletes and celebrities conduct themselves the way they want to because they are rich but nonetheless, they will be judged based on what they do rather than their character because of the values, ideas, and beliefs different culture hold. Immigrants do not have to assimilate or reject American worldviews to live in America but instead a more effective solution is to recognize these cross cultural differences and consciously negotiate them.
